For purposes of data protection laws, Zyante Inc., located at 41 East Main Street, Los Gatos, CA 95030, is the “data controller” of your information.
We believe that you have the right to understand how your information is stored and used. We require that sites linked to our Site contain a notice identifying their privacy policies. We are not responsible for the privacy practices of any third parties or the content of linked sites, although we do encourage you to read the applicable privacy policies and terms and conditions of such parties or web sites.
Information You Provide Us
In general, you can visit portions of zybooks.com without providing us any information about yourself directly. If you wish to obtain information about our products or services you can contact us. We will collect your name, company or school name, email address, and street address, along with other information you may choose to submit, as part of the inquiry process.
Portions of zybooks.com are accessible only to subscribers. In order to register on our site and become a subscriber you will be required to provide information such as your name, address, school affiliation and class, email address, and payment information. You agree that you will only provide current, accurate information and that you will keep your information up to date. In the course of your use of the Site we may collect information based on the pages you visit, the activities or exercises you engage in or perform, and statistics about your performance.
Please note that in some cases, we need certain types of information so that we can provide you with the services you request. If you do not provide us with such information, or ask us to delete it, you may not be able to obtain these services.
Protecting Children’s Privacy
This Site is not designed nor intended for use by children under the age of 13 (“Minors”). We do not knowingly collect personally identifiable information (as defined by the United States Children’s Online Privacy Protection Act) from Minors. If you are under the age of 13, please do not submit any information to us. If you are an enrolled student but are under the age of 13 please contact us at email@example.com to subscribe to our service.
We do not knowingly collect data from European Economic Area (“EEA”) residents under the age of consent set by applicable data protection law. If we learn that we are processing data of such an individual, we will halt such processing and will take reasonable measures to promptly remove applicable data from our records.
Use of Information
We may use aggregated data (independent of any personal identifiers) for research and commercial purposes. This information may include what areas our users visit most frequently and what services they access most often. This information helps us develop a better site that is more useful and accessible to you.
We may use information you provide to us internally for our general commercial purposes including, among other things, to offer our own, our affiliates’ or third-party products and services that we think you may find of interest, but only Zyante, its subsidiaries and contractors involved in distributing the offers or providing the products or services will have access to your information. Our subsidiaries and contractors will be required to use any personally identifiable information we provide them only for that intended purpose. We may use your email address to contact you to respond to your inquiries or to provide information on products or services to you. You can elect not to receive emails from us either by “unsubscribing” to an email you receive or by contacting us as indicated below. If you unsubscribe we may still send you emails relating to your account or transactions with Zyante. We also use your information to operate, maintain, and improve the Site and for our internal recordkeeping purposes.
Legal Bases for Use of Your Information
The laws in some jurisdictions require companies to tell you about the legal ground they rely on to use or disclose your “personal data” (as defined in such applicable laws). To the extent those laws apply, our legal grounds are as follows:
- To honor our contractual commitments to you: Much of our processing of personal data is to meet our contractual obligations to our users, or to take steps at users’ requests in anticipation of entering into a contract with them. For example, we handle personal data on this basis to provide you a subscription to zyBooks.
- Consent: Where required by law, and in some other cases, we handle personal data on the basis of your implied or express consent.
- Legitimate interests: In many cases, we handle personal data on the ground that it furthers our legitimate interests in commercial activities in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals. This includes: operating our business and the Site; providing security for the Site, products, software, or applications; marketing; making and receiving payments; and preventing fraud.
- Legal compliance: We need to use and disclose personal data in certain ways to comply with our legal obligations (such as our obligation to share data with tax authorities).
Opt-Out, Access, and Security
If you do not wish to receive offers, promotional materials or marketing communications from us in the future, you can “opt out” by contacting us by email at firstname.lastname@example.org with “unsubscribe” or “opt out” in the subject line or by mail at the address listed at the end of this policy. For users who are EU residents or may otherwise be covered by GDPR, we are in the process of finalizing an “opt in” procedure and will update this policy once that procedure is in place. In the meantime, if you are an EU resident and you receive a communication which you believe we should not have sent to you, please immediately notify us through the procedure set forth in the preceding sentence and we will not contact with offers, promotions or marketing materials in the future. To review your subscription information, make any changes or corrections or to request that we remove your information please visit the My Account tab or send an email to email@example.com with your question. We will try to complete your request as promptly as possible. Any changes will affect only future uses of your information.
Note that if you choose not to receive offers, promotional materials or marketing communications, we may still send you non-promotional communications, such as security alerts and notices related to your access to or use of our site or related services, or those about your online account or our ongoing business relations.
If you are a subscriber, you are responsible for maintaining the confidentiality of your account and password. If you use this Site, you are responsible for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.
We will use appropriate physical, technical and administrative safeguards to protect your data. Access to your personal data will be restricted to only those who need to know that information and required to perform their job function. In addition, we train our employees about the importance of maintaining the confidentiality and security of your information.
Data Subject Rights
Residents of the EEA can exercise certain data subject rights available to them under applicable data protection laws. Where such rights apply, we will comply with requests to exercise these rights in accordance with applicable law. Please note, however, that certain information may be exempt from such requests in some circumstances, which may include if we need to keep processing your information for our legitimate interests or to comply with a legal obligation. - Obtain access to or a copy of certain personal data we hold about you
- Prevent the processing of your personal data for direct marketing purposes
- Update personal data which is out of date or incorrect

Retention of Your Information
We keep your information for no longer than necessary for the purposes for which it is processed and/or as required to comply with applicable laws.
Consent to Processing
Your Personal Information may be processed by us in the country where it was collected as well as other countries, including the United States, where laws regarding data protection may be less stringent than the laws in your country. By using this site and by providing any Personal Information to the Site, all users, including without limitation users in Canada and the European Union, fully understand and unambiguously consent to the collection and processing of such information in the United States.
Zyante is currently in the process of self-certifying to the EU-U.S. and Swiss-U.S. Privacy Shield Protocols. We will post a new policy including all mandatory Privacy Shield terms and conditions as soon as we receive approval from the Federal Trade Commission. Until then, we will follow the principles and terms of Privacy Shield when it comes to your personal information and how we use it.

If you are a user domiciled in the EU and covered by GDPR, we will provide a systematic approach to managing your personal information through our people, management processes and information systems by applying a risk management methodology that is consistent with and in furtherance of the fundamental principles of GDPR. California Privacy Rights
California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (as defined by applicable California law) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. We do not currently disclose personal information to third parties for their direct marketing purposes.
Do Not Track
Our site, applications or other services do not respond to Do Not Track signals, as the Internet industry is currently still working on Do Not Track standards, implementations, and solutions.
