We use cookies to personalize our Site for you and to collect aggregate information about site usage by all of our users. A cookie is a text file that our Site transfers to your computer’s hard drive for record-keeping purposes and to enhance the quality of your visit to our Site. The cookie may assign a random, unique number to your computer. We use persistent cookies that remain on your browser after you leave the Site as well as session cookies that expire when you exit the Site. Our cookies record “clickstream” information (data reporting the URLs or names of the pages on our Site that you have visited). We use persistent cookies, for instance, to remember you when you return to the site and to connect you and your subscriber account activity. We also allow third parties to set cookies that help us maintain and operate our Site or to help our Site offer certain features, such as YouTube video access. We do not intentionally allow anyone else to access your cookie. You can set your browser to refuse cookies, but doing so may limit system performance and may even cause certain features of the Site to malfunction or not to work at all.

Use of Information

We may use aggregated data (independent of any personal identifiers) for research and commercial purposes. This information may include what areas our users visit most frequently and what services they access most often. This information helps us develop a better site that is more useful and accessible to you.

We may use information you provide to us internally for our general commercial purposes including, among other things, to offer our own, our affiliates’ or third-party products and services that we think you may find of interest, but only Zyante, its subsidiaries and contractors involved in distributing the offers or providing the products or services will have access to your information. Our subsidiaries and contractors will be required to use any personally identifiable information we provide them only for that intended purpose. We may use your email address to contact you to respond to your inquiries or to provide information on products or services to you. You can elect not to receive emails from us either by “unsubscribing” to an email you receive or by contacting us as indicated below. If you unsubscribe we may still send you emails relating to your account or transactions with Zyante. We also use your information to operate, maintain, and improve the Site and for our internal recordkeeping purposes.

We may reveal personally identifiable information about you to unaffiliated third parties: (1) if you request or authorize it; (2) if the information is provided to help complete a transaction for you including disclosing your information to school officials including instructors for a legitimate educational interest; (3) if the information is provided to comply with the law, applicable regulations, governmental and quasi-governmental requests, court orders or subpoenas, to enforce our Terms of Use or other agreements, or to protect our rights, property or safety or the rights, property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection etc.); (4) if the disclosure is done as part of a purchase, transfer or sale of services or assets (e.g., in the event that substantially all of our assets are acquired by another party, subscriber information may be one of the transferred assets); (5) if the information is provided to our agents, outside vendors or service providers to perform functions on our behalf (e.g., analyzing data, providing marketing assistance, providing customer service, processing orders, etc.); or (6) as otherwise described in this Privacy Policy.

Legal Bases for Use of Your Information

The laws in some jurisdictions require companies to tell you about the legal ground they rely on to use or disclose your “personal data” (as defined in such applicable laws).  To the extent those laws apply, our legal grounds are as follows:

  • To honor our contractual commitments to you:  Much of our processing of personal data is to meet our contractual obligations to our users, or to take steps at users’ requests in anticipation of entering into a contract with them.  For example, we handle personal data on this basis to provide you a subscription to zyBooks.
  • Consent:  Where required by law, and in some other cases, we handle personal data on the basis of your implied or express consent.
  • Legitimate interests:  In many cases, we handle personal data on the ground that it furthers our legitimate interests in commercial activities in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals.  This includes: operating our business and the Site; providing security for the Site, products, software, or applications; marketing; making and receiving payments; and preventing fraud.
  • Legal compliance:  We need to use and disclose personal data in certain ways to comply with our legal obligations (such as our obligation to share data with tax authorities).

Opt-Out, Access, and Security

To review your subscription information, make any changes or corrections or to request that we remove your information please visit the My Account tab or send an email to info@zybooks.com with your question. We will try to complete your request as promptly as possible. Any changes will affect only future uses of your information.

Note that if you choose not to receive offers, promotional materials or marketing communications, we may still send you non-promotional communications, such as security alerts and notices related to your access to or use of our site or related services, or those about your online account or our ongoing business relations.

If you are a subscriber, you are responsible for maintaining the confidentiality of your account and password. If you use this Site, you are responsible for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.

We will use appropriate physical, technical and administrative safeguards to protect your data. Access to your personal data will be restricted to only those who need to know that information and required to perform their job function. In addition, we train our employees about the importance of maintaining the confidentiality and security of your information.

Data Subject Rights

Residents of the EEA can exercise certain data subject rights available to them under applicable data protection laws.  Where such rights apply, we will comply with requests to exercise these rights in accordance with applicable law.  Please note, however, that certain information may be exempt from such requests in some circumstances, which may include if we need to keep processing your information for our legitimate interests or to comply with a legal obligation.  If these rights apply to you, they may permit you to request that we:

  • Obtain access to or a copy of certain personal data we hold about you
  • Prevent the processing of your personal data for direct marketing purposes
  • Update personal data which is out of date or incorrect
  • Delete certain personal data which we are holding about you
  • Restrict the way that we process and disclose specific personal data about you
  • Transfer your personal data to a third-party provider of services
  • Revoke consent that you previously provided for the processing of your personal data

For more information on how to exercise these rights, contact us using the information in the “Contacting Us” section below.  If applicable, you may make a complaint to the data protection supervisory authority in the country where you are based. Alternatively, you may seek a remedy through local courts if you believe your rights have been breached.

Retention of Your Information

We keep your information for no longer than necessary for the purposes for which it is processed and/or as required to comply with applicable laws.

Consent to Processing

Your Personal Information may be processed by us in the country where it was collected as well as other countries, including the United States, where laws regarding data protection may be less stringent than the laws in your country. By using this site and by providing any Personal Information to the Site, all users, including without limitation users in Canada and the European Union, fully understand and unambiguously consent to the collection and processing of such information in the United States.

Zyante is currently in the process of self-certifying to the EU-U.S. and Swiss-U.S. Privacy Shield Protocols.  We will post a new policy including all mandatory Privacy Shield terms and conditions as soon as we receive approval from the Federal Trade Commission.  Until then, we will follow the principles and terms of Privacy Shield when it comes to your personal information and how we use it.

Where required, we will use appropriate safeguards when transferring your data outside of EEA.  For more information about these safeguards, please contact us as detailed in the “Contacting Us” section below.

We do not currently disclose personal information to third parties for their direct marketing purposes.
